Dog Bite Liability in the City of Perry in Houston County and Paulding County, Georgia

If an owner or other person responsible for the care of a dog is proven negligent, Georgia law allows victims of dog bite attacks to recover compensation. For the sake of victims of animal attacks, we keep current with changes in the law and local ordinances which can affect the outcome of a case. Perry County, Georgia has some rules regarding dog restraint we feel people should be aware of:

Perry, Georgia – Code of Ordinances, Sec. 4-29. – Restraint of animals;

It shall be unlawful to restrain an animal by tethering or any similar use of a chain, cable, rope or other stakeout or tie-out devices.

The same ordinance is more similar to the standard Georgia code as set forth by

Paulding County, Georgia – Code of Ordinances, Sec. 14-14. – Requirements for dogs classified

It shall be the duty of any animal owner to ensure an animal is under control of its owner and to prevent the animal from having access to the property of another person. An animal may leave the property of the animal owner, but the animal owner must have the animal under control and must prevent the animal from having access to the property of another person without the permission of that person, or from attacking, threatening or harassing other persons, or from damaging another person’s property. No animal shall be allowed to roam free and when not on the property of its owner must be on a leash, or similar physical control device, and in the control of a person. This section shall not apply to community cats or community cat caregivers.

Any owner of a domestic animal will confine that animal inside a building or fenced enclosure. No animal shall be tied as a permanent measure of restraint, nor left unattended on a chain, lead, runner, cable, rope, leash, or similar tethering device in an unfenced area where people or other animals can wander into the tethered animal’s proximity. Any animal owner restraining an animal without the use of a fenced enclosure will be in violation of this chapter.

Ordinances can differ from the state within a county or city. The language for the City of Perry is “restrain an animal” with no qualifiers. While Paulding County includes specifics found in the standard Georgia code to their ordinance such as “permanent measure of restraint” and the animal is not to be “left unattended.”

Pet owners of dogs that have gotten loose or have attacked other people need to be aware that they must respond promptly to any notice of their dog being classified as dangerous.
